Drunk Driving (OUI / DUI / DWI)

1st Offense - Operating Under the Influence:

An individual charged with Operating Under the Influence faces the possibility of 2½ years in the House of Correction and fines/fees. They can also have their license suspended for 1-year; however, a hardship license may be obtained in 3 months for work or educational purposes and in 6 months for general purposes.

24D DispositionSecond Chance 24D:

If an individual is charged with an OUI for the first time, the judge may allow for a 24D Disposition. This includes probation, a license suspension for 45 to 90 days, and attendance and completion of a drunk driving program, which lasts approximately 16 weeks. There are fines and fees in addition to these requirements.

Second Chance 24D:

If an individual was charged with a first offense OUI ten or more years ago, they may be eligible to repeat the drunk driving program. There are fines and fees in addition to these requirements.

2nd Offense - Operating Under the Influence:

If an individual has been charged with a Second OUI offense, they face a minimum of 60 days in the House of Correction; however, the sentence could be up to 2½ years. An ignition interlock device is required for any vehicle the individual drives (they may not operate a commercial vehicle or motorcycle during this time). Additionally, their license will be suspended for 2 years, and they will have to pay multiple fines and fees.  

A hardship license for work or education may be applied for after 1 year. If the individual wants a general hardship license, it will be after 1½ years.

3rd Offense - Operating Under the Influence:

If an individual has been charged with a 3rd offense OUI, they face a mandatory 150 days imprisonment and a minimum of 6 months in the House of Correction; however, the sentence could be anywhere up to 2½ years in the House of Correction or 2½ - 5 years in state prison. An ignition interlock device is required for any vehicle the individual drives (they may not operate a commercial vehicle or motorcycle during this time), and their license will be suspended for 8 years. There are fines and fees in addition to these requirements. This offense is a felony.

A hardship license for work or education may be applied for after 2 years. If the individual wants a general hardship license, it will be after 4 years.

4th Offense - Operating Under the Influence:

If an individual has been charged with a 4th offense OUI, they face a mandatory 1-year imprisonment and a minimum 2 years in the House of Correction. However, the sentence could be anywhere up to 2½ years in the House of Correction or 2½ - 5 years in state prison. An ignition interlock device is required for any vehicle the individual drives (they may not operate a commercial vehicle or motorcycle during this time), and their license will be suspended for 10 years. There are fines and fees in addition to these requirements. This offense is a felony.

A hardship license for work or education may be applied for after 5 years. If the individual wants a general hardship license, it will be after 8 years.

5th Offense - Operating Under the Influence:

If an individual is charged with a 5th offense OUI, they face a minimum of 2½ years in the House of Correction or 2½ - 5 years in state prison. In this instance, the individual would lose their license for life. In addition to these requirements, there are fines and fees.

A hardship license is not available.
